Member for Nanango Deb Frecklington is proud to have introduced Breach Bail, Go to Jail and Other Legislation Amendment Bill 2026 to Parliament and will deliver the strongest bail laws in the country. This landmark legislation is part of the nation leading overhaul and the next stage of Adult Crime, Adult time.
Under the next phase of the Government’s Adult Crime, Adult Time reforms, offenders who commit a serious offence while on bail for an Adult Crime, Adult Time offence will face a new standalone offence carrying a mandatory minimum sentence of 12 months imprisonment, to be served in custody.
The Bill introduces major changes, including:
- Creating a standalone offence for committing a serious offence while released on bail. The offence carries a mandatory minimum custodial sentence of 12 months imprisonment, to be wholly served in custody.
- Strengthening the bail threshold for serious offenders by introducing a new “high degree of confidence” test. Under the test, police or a court must refuse bail unless satisfied to a high degree of confidence that the offender will not commit another serious offence while on bail.
- For youth offenders this is any Adult Crime, Adult Time offence.
- For adults, a serious offence includes all Adult Crime, Adult Time offences, as well as coercive control and Daniel’s Law child sexual offences.
These reforms are a direct response to community concerns about repeat offenders committing serious crimes while on bail.
Mrs Frecklington said the reforms reinforce the Government’s commitment to restoring safety and confidence in the justice system.
“I’ve listened to our community, and they’ve made it clear that enough is enough,” Deb said.
“Our community has watched offenders receive chance after chance, only to reoffend while out on bail.
“We promised Queenslanders we would do whatever it takes to make our communities safer, and that’s exactly what we’re doing,” she said.
The proposed laws will now proceed through consultation and the Parliamentary committee process before being considered by Parliament.
